Citizens Challenge Chief Justice’s Removal in Supreme Court

Accra, March 27, GNA – An individual has brought forth a case before the Supreme Court regarding the removal of Chief Justice Gertrude Sackey Torkornoo.

The petition submitted by Godfred Yeboah Dame, who previously served as Attorney General, on behalf of Vincent Ekow Assifuah, targeting the current Attorney General, seeks the following remedies.

Mr. Assifuah, who serves as both the plaintiff and the Member of Parliament for Old Tafo, is aiming to obtain a genuine and accurate interpretation of specific articles within the Constitution: namely Articles 146(1), (2), (4), (6), and (7); Article 23; Article 57(3); and Article 296.

The statement indicated that the President had the responsibility to inform the Chief Justice regarding a petition seeking her ouster. This would involve obtaining her remarks and reactions to the petition prior to submitting it to the Council of State for their input and deliberation.

The plaintiff is additionally requesting an accurate interpretation of Articles 146 (1), (2), (4), (6), and (7), as well as Articles 23 and 296 of the Constitution.

“A president’s failure to inform the Chief Justice and secure their input regarding a petition for removing the Chief Justice prior to engaging the Council of State in consultations constitutes an undue infringement upon judicial independence as outlined in Articles 127(1) and (2) of the Constitution,” stated the writ.

This action also infringed upon the basic right to a fair trial as outlined in Articles 23 and 296, rendering the procedures established by the President for removing the Chief Justice ineffective, invalid, and devoid of legal force.
